To ask the Minister for Employment Affairs and Social Protection the number of judicial review cases his Department has defended in each of the past ten years; the number in relation to which proceedings are pending or continuing; the number of cases which were lost and won, respectively, in the same period; the number of cases that settled in the past ten years; and if he will make a statement on the matter. As the Deputy will be aware, legal cases may be resolved in a variety of ways. The resolutions are not limited to the proceedings being won, lost or settled. The proceedings may be contested, and partly won or partly lost. They may be entirely settled and subject to confidentiality provisions including as to the fact of the settlement. The proceedings may be withdrawn by the applicant before the case runs on their own volition or on foot of an agreement. The proceedings may have become moot. The number and nature of possible conclusions of judicial review proceedings, and the protracted period of time in this question do not allow for a reliable figure to be provided with regard to those outcomes.
