859. To ask the Minister for Housing, Planning, and Local Government the EU legislation that requires transposition into Irish law and awaiting referral to an Oireachtas committee; to provide a timeline for this; and if he will make a statement on the matter. [30626/25]

Instruments used to transpose EU law are referred to Oireachtas Committees in two circumstances. When transposition is being carried out through primary legislation, the Bill is referred to the relevant Committee for both pre-legislative and Committee State consideration, as with any other Bill.

However, most transpositions are made through Statutory Instruments under the European Communities Act 1972. In these cases, the Department of Foreign Affairs periodically agrees a list of draft EU Statutory Instruments for review by the Seanad Select Committee on Scrutiny of draft EU-related Statutory Instruments. Following its review, the Seanad Committee refers any detailed issues to the appropriate Oireachtas Committee.

In my Department, there are two EU Directives that require transposition into Irish law, as follows:

Directive (EU) 2024/3019 of the European Parliament and of the Council of 27 November 2024 concerning urban wastewater treatment (recast) 31-07-2027
Directive (EU) 2024/1275 of the European Parliament and of the Council of 24 April 2024 on the energy performance of buildings (recast) 29-05-2026
It is intended that Directive (EU) 2024/3019 will be transposed by means of Statutory Instruments under the European Communities Act 1972.

In the case of Directive (EU) 2024/1275, primary legislation is required for certain articles while others can be transposed administratively or by Statutory Instrument under the European Communities Act 1972. I plan to bring a Memorandum to Cabinet in the coming weeks with Heads of Bills and seeking approval to begin the drafting of a Bill to legislate for many requirements of the Directive. Following approval, I will engage with the appropriate Joint Oireachtas Committee with regard to pre-legislative scrutiny.
