The case referenced by the Deputy has been lodged as an appeal by the teacher to the relevant unit in the Department as provided for under Circular 0030/2018 titled Adjudication Process – Contracts of Indefinite Duration. In accordance with this circular, the appeal is currently under review and will be referred to the independent Adjudicator appointed to review appeals cases.
The Adjudicator will review the written submission made by the parties and come to a determination based on their own legal judgement and expertise. As this is an independent process it would not be appropriate for me to comment further until this process has been completed.
