The Employment Permits Section of the department informs me that an application to change employer was received from the person concerned on 8 April. The applicant was advised on 22 April that as the salary listed in the application was below the required threshold, it could not be accepted. The applicant was advised that they could submit a new application which met the required salary threshold.

To date, no new application has been received. The Employment Permits Unit will contact the applicant to provide guidance on submitting the new application.

My Department is committed to delivering an efficient and responsive employment permit system which supports businesses while also protecting worker’s rights. Where rights violations are reported to Department, the Employment Permits Section can request that the Workplace Relations Commission carry out an inspection on the Department's behalf.

The Workplace Relations Commission plays a role in ensuring the enforcement of the rules in regard to employment permits by ensuring that permit holders are working in the correct roles and are in receipt of the correct remuneration as stated on their permits.

If employees working for the company concerned are not in receipt of the remuneration as stated on their employment permit this would be considered a breach of the employment permits legislation.

The Employment Permits Section informs me that to date no complaints have been received regarding the company concerned. The Department will action an inspection request on foot of the information provided in the details supplied.

Any permit holder who has concerns over breaches of employment legislation should contact the Department - either through the Employment Permits Unit (employmentpermits@enterprise.gov.ie) , or the Workplace Relations Commission. The Migrant Rights Centre of Ireland, the national organisation working with migrants and their families, can also provide support to employment permit holders.
