Public Procurement Contracts

To ask the Minister for Rural and Community Development if framework-based procurement is included in his Department’s reporting of “tendered” procurement in its annual accounts; if so, to distinguish between contracts awarded via framework mini-competition, contracts awarded via direct drawdown from a framework without competition and frameworks run independently by his Department versus those centrally established by the Office of Government Procurement; and to provide the value of procurement for each such category in the past three years. 906. To ask the Minister for Rural and Community Development to provide a list of all framework agreements used by his Department or its agencies since 2022, by name and description of framework; if it was established by his Department, the OGP, or another central/sectoral body; if it is a single-supplier or multi-supplier framework; if drawdowns required mini-competitions; and the total number of contracts and aggregate value of payments made under each framework agreement, by year. To ask the Minister for Rural and Community Development if all drawdowns from frameworks by his Department or its agencies from 1 January 2022 to 31 December 2024, valued over €25,000 were accompanied by publication of a contract award notice on the eTenders portal as required by Circular 05/2023; and if not, to list any known contracts where such publication did not occur and the reason. I propose to take Questions Nos. 905, 906 and 907 together.

My Department reports all relevant procurement of goods and services to the Office of the Comptroller and Auditor General (OCAG) as part of the preparation of its annual accounts, including goods or services procured using the Office of Government Procurement (OGP) frameworks. An annual contracts register of all procurement over €25,000 (excluding VAT) is provided to the OCAG as part of this reporting, whether procured by framework or not. In this context, I note my reply to previous parliamentary questions, PQ7512/25 and PQ7530/25, which provided full details on all procurement over €25,000 (excluding VAT)

Regarding specific framework agreements utilised by the Department since 2022, these are provided in the table below. The Department used six framework agreements for seven contracts for a combined value of €1.168 million. Three were direct OGP frameworks, two were OGP mini competitions and one was an independent framework relating to minor capital works put in place by the Islands Unit in the Department. The latter was for small scale capital improvements to be delivered for remedial work at relevant airports.

As regards the publication of Contract Award Notices, the following guidance is provided by the Office of Government Procurement;
  • Contract Award Notices (CAN) resulting from a mini competition conducted by the OGP, under an OGP framework or DPS on behalf of the client are captured and published by the OGP Sourcing Team. This is provided for on the etenders platform.
  • In relation to direct drawdown, the original Framework CAN notice value captures all prospective future drawdowns by clients. A Department does not need to publish a CAN in this instance.
  • In the instance where clients utilise OGP central arrangements via the “self-Serve” option – this is where the client runs their own mini-competition without any OGP assistance, it is clients responsibility to publish the contract award notice on the e-tenders platform.
The Department has followed the above guidance for the relevant contract, however, with regard the two contracts procured under the multi-participant 'Framework for Maintenance and Refurbishment works at Aerfort Árann, Aerfort Inis Meáin agus Aerfort Inis Oírr' in 2023, the contract award notices were not published. This was an oversight, with all other aspects of the OGP guidance on utilising an independent framework followed. I have reminded my senior officials of the need to follow through on all procurement processes in the future, including the separate need to publish the award notices, as required.

With regard to agencies of the Department, there are four agencies under the remit of my Department, the Charities Regulator, the Western Development Commission, Water Safety Ireland and Pobal. These agencies are independent legal entities responsible for managing their own corporate affairs in compliance with statutory obligations and the Code of Practice for the Governance of State Bodies. I have requested similar information from the agencies and will revert to the Deputy within ten days.
