To ask the Minister for Children, Equality, Disability, Integration and Youth if there is any differential made in the HIQA standards for the care of persons under 65 and the care for persons over 65, or any other age, in nursing homes; and if she will make a statement on the matter. The legal framework for the regulation of nursing homes in Ireland is set out in the Health Act 2007 (as amended), associated regulations and nationally mandated standards. The Act and the regulations provide the legal framework for how nursing home care must be delivered which a registered provider must adhere to in order to remain registered and to continue to operate their nursing home.

The National Standards for Residential Care Settings for Older People in Ireland (2016), place a strong focus on quality of life and a person-centred approach to care for all residents. This applies to the care of people of any age or capacity living in a designated centre for older people.

Although older persons services regulations are not the same as the disability regulations, there are similarities. However, the regulations are sector-specific and focus on the needs of those who live in each type of service. For your convenience the regulatory framework for regulating designated centres for older people and people with disabilities in Ireland is as follows below:
