193. To ask the Minister for Enterprise, Trade and Employment if the case of a person (details supplied) will be examined; and if he will make a statement on the matter. [26491/25]

In order to be granted a General Employment Permit in respect of the role concerned, there is a requirement under the Employment Permits legislation that the vacancy concerned should be advertised for a minimum of 28 days on an online platform. This is a legal requirement, known as the Labour Market Needs Test. I note that the application concerned was only advertised for 18 days. In the interest of fairness to all potential applicants in respect of the role concerned, it is not possible to make any exceptions to this rule.

If the prospective employer concerned wishes to re-advertise the vacancy for the required 28 days and resubmit the application showing proof that it was advertised for the required period, the Department will then be in a position to reconsider the application.
