40. To ask the Minister for Finance further to Parliamentary Question No. 292 of 8 May 2025, to clarify that the current CEO of NAMA will not transfer to the resolution unit; if a pathway for return to NTMA without being part of the resolution unit will be provided for the current CEO of NAMA or any other NAMA staff; and if he will make a statement on the matter. As the Deputy will be aware, all NAMA staff are employed by the NTMA and assigned to NAMA under Section 42 of the NAMA Act of 2009.

A Resolution Unit will be established and resourced by the NTMA, with responsibility for managing any residual activity of NAMA following its dissolution and any residual activity of IBRC (in Special Liquidation).

It is anticipated that the Resolution Unit will sit within an existing function in the NTMA, reporting to senior management. Based on the estimated volume and nature of the residual activity expected to transfer to the NTMA, it is currently envisaged by the NTMA that the Resolution Unit will require approximately 10 staff members, including the head of the unit (the role for which will not be performed by the current CEO of NAMA).

Resolution Unit roles will be open to current NAMA employees owing to the importance of retaining corporate and NAMA specific knowledge. More generally, NTMA vacancies are typically advertised and all NTMA staff members (including NAMA staff) can apply for open roles.

As regards the potential for the current CEO of NAMA or any other NAMA staff to return to the NTMA outside of the Resolution Unit, I am advised by the NTMA that no final arrangements have been made at this time. Any future decisions in this regard will be made having regard to the contractual position of the individuals concerned.

The majority of remaining NAMA staff are employed on specified purpose contracts, linked to the needs and existence of NAMA, and in the ordinary course their employment will cease following dissolution of NAMA and the completion of a period of garden leave.
