To ask the Minister for Employment Affairs and Social Protection the position regarding the four-year limit on the refund of PRSI as set out in the Social Welfare and Pensions (No.2) Act 2009; the basis for this decision; if the time period is under; and if he will make a statement on the matter. Section 8 of the Social Welfare & Pensions (No 2) Act, 2009 provided for a statutory limitation on the return of PRSI contributions made in error – on refund applications made from 1 January 2010.
This Section provides that the PRSI refund application must be made within 4 years of the last day of the contribution year in respect of which contributions concerned were paid.
As this matter is the result of legislation passed by the Oireachtas, on foot of a decision made by the Government and not the result of a decision made by an Officer of the Department, the matter is not appealable. There are no grounds of appeal to the Department or to the Social Welfare Appeals Office on clear and unambiguous legislation passed by the Oireachtas.
