The Government does not support the Boycott, Divest and Sanction (BDS) approach, although individuals and organisations have the right to make their own decisions.

In European law, Directive 2014/24/EU and its transposing statutory instrument – S.I. No. 284/2016 – provides for the exclusion from tender processes economic operators who have been subject of a conviction by way of final judgement for certain offences. It should be noted that this exclusion applies to natural and legal persons only, and not states or geographical regions. Concerning exclusions of states or geographical regions, this is a matter of international trade.

Any signatory to the World Trade Organisation and the Agreement on Government Procurement has full rights of access to the EU public procurement market no less favourable than any other peer signatory. Any move to restrict that access or vary public procurement rules less favourable to any party would be in breach of such agreements to which Ireland is committed as an EU Member State.
