Work Permits

525. To ask the Minister for Enterprise, Trade and Employment the status of a work permit application for a person (details supplied); and if he will make a statement on the matter. [23453/25]

The Employment Permits Section of the Department informs me that it has not received a recent application in respect of the person in the details supplied.

On the 3rd of July 2024 a renewal application was received in respect of the person concerned and on the 9th of October 2024 it was refused as the application was for a role with a different employer to the employer stated on the permit held. There was also an issue with the contract of employment submitted with the application.  At the time the applicant was informed of their right to request a review of the refusal decision but no appeal was submitted. In November 2024 90% of the fee paid was refunded to the cardholder/payer card.

As the permit held in respect of the person concerned expired in May 2024 it is no longer possible to submit a renewal application. Therefore in order to be considered for an employment permit, a new application is required to be submitted in respect of the person concerned.

It should be noted that it is an offence under employment permit legislation for  a non-EEA national to be in employment in the State without either a valid employment permit or permission from the Minister for Justice to be in employment without the need for an employment permit.
