Deportation Orders

316. To ask the Tánaiste and Minister for Justice and Equality the number of deportation orders that have been revoked by his Department in each of the past ten years; and if he will make a statement on the matter. [22258/25]

Section 3(11) of the Immigration Act 1999, as amended, provides that a deportation order may be revoked. My Department receives submissions from people seeking that this provision be invoked. In assessing such submissions consideration is given to whether there is compelling new information or material changes in circumstances which were not previously put forward, nor capable of being put forward, when the original decision was made.
The main grounds advanced relate to the extent to which a person has established family, employment and other connections here. All submissions are carefully assessed including in the context of any rights arising and a criminal records check is carried out in each instance.
Deportation Orders may also be revoked on technical grounds such as where a person has been admitted or readmitted to the international protection process and permitted to remain in Ireland while their application is considered.
The Deportation Orders of people who qualified under the terms of the Regularisation of Long-Term Undocumented Migrants Scheme in 2022, the processing of which is now largely concluded, were revoked and these revocations are included in the figures set out below.
The table below details the number of deportation orders revoked under Section 3(11) of the Immigration Act 1999, as amended.
