To ask the Minister for Transport, Tourism and Sport the position regarding any payment made to Dún Laoghaire-Rathdown County Council as part of the transfer of ownership of Dún Laoghaire harbour to the local authority; if the details of that payment could be outlined; and if he will make a statement on the matter. I propose to take Questions Nos. 357 and 358 together.
In line with National Ports Policy (2013) and with legislative provisions, as set out in the Harbours Act 2015, control of the five designated Ports of Regional Significance, including Dún Laoghaire Harbour Company, was transferred to more appropriate local authority led governance structures.
On the date of transfer, 3 October 2018, all assets, liabilities and staff of Dún Laoghaire Harbour Company transferred to Dún Laoghaire-Rathdown County Council. In accordance with National Ports Policy, no State funding was provided to Dún Laoghaire-Rathdown County Council as part of the transfer and I can confirm that no specific provision was provided for maintenance of the sun shelter on the east pier of the harbour.
Following the transfer of the five Ports of Regional Significance to local authority control, where a port company transferred under the transfer of shareholding model, the company continues, as before, to fund all activities from its own resources. In the case of a port company such as Dún Laoghaire Harbour Company, that was dissolved and transferred directly to the local authority and the port continues to generate income from port activities under the local authority.
Maintenance of Dún Laoghaire Harbour Company and its property is therefore the responsibility of Dún Laoghaire Rathdown County Council.
