As this is an operational matter, I have asked the HSE to respond directly to the Deputy.

As a general principle, services in receipt of grant funding from the HSE under section 39 of the Health Act 2004 are governed by a Grant Agreement between the HSE and the service provider. It is important to note that staff employed by independently operated service providers are not public servants and do not have public service pensions. Terms and conditions of employment, once in line with employment legislation, are strictly a matter between the funded organisation and its employees.
