Ireland did not opt in to this Directive under Article 3 of Protocol 21 of the Treaty of the Functioning of the European Union. This decision was based on concerns about the legal basis underpinning the Directive, and potential incompatibility with the Irish legal system.

In Ireland’s case, protection orders are a preventive measure governed by civil law. In the area of family law, Ireland is participating in a related measure, Regulation (EU) No 606/2013 of the European Parliament and of the Council of 12 June 2013 on mutual recognition of protection measures in civil matters.
