1595. To ask the Tánaiste and Minister for Justice and Equality if he will advise on any work being undertaken in his Department on enabling regulations under the terms of the Data Protection Act 2018 to allow for the development of a shared fraud database in Ireland; if his Department is engaging with the Department of Finance, the Central Bank and any other relevant Departments and agencies on this issue; and if he will make a statement on the matter. The Programme for Government commitment referred to by the Deputy relates specifically to the information-sharing database that Banking & Payments Federation Ireland plans to develop on behalf of its members. The proposed database will allow participating financial institutions to share certain information for the purposes of helping to identify and prevent fraud.

Legal advice provided to my Department is that the proposed database will require an authorising legal basis by way of regulations under the Data Protection Act.

As noted in the National Payments Strategy which was launched by the Minister for Finance in October, it is intended to develop this legislation in 2025.

That work is underway in my Department and I look forward to bringing forward the regulations as soon as possible.
