Section 28 of the Electoral Act 1992 provides that each local authority shall, following consultation with the local returning officer for Dáil elections, make a scheme dividing the county or city into polling districts for the purpose of Dáil, European and local elections and appointing a polling place for each polling district.
The selection of polling stations is then a matter for the returning officer. Section 94 of the Act provides that in every polling place the returning officer shall provide a sufficient number of polling stations, conveniently distributed for the accommodation of the Dáil electors entitled to vote there.
An Coimisiún Toghcháin has no role in relation to the selection of polling stations.
