1019. To ask the Minister for Health if she has been in communication with the Department for Social Protection as part of the interdepartmental working group tasked with assessing the impact of a new, non-binary, category of gender on existing legislation; when he is planning the next meeting with the representatives from the Department for Social Protection to investigate legislative implications of non-binary gender recognition; and if she will make a statement on the matter. As the Deputy will be aware, gender recognition arrangements are a matter for the Department of Social Protection.

Under Section 7 of the Gender Recognition Act 2015 (GRA 2015), the Minister for Employment Affairs and Social Protection was required to commence a review of the Act within 2 years of its coming into operation, and to report to the Oireachtas within 12 months of the commencement of the review. The implementation of the review groups recommendations is a matter for the Minister for Employment Affairs and Social Protection.

However, my department will play our part in any working groups established to consider the implementation of this recommendation.
