823. To ask the Minister for Children, Equality, Disability, Integration and Youth if she plans to exercise powers under section 47(1) Child and Family Agency Act 2013 to give additional direction to Tusla regarding the proposal for approved in principle by Tusla's National Policy Oversight Committee in Tusla's draft review 'Personal Data Breach Management Policy Procedure' to discontinue notifying the Data Protection Commission of 'personal data breach incidents' assessed as resulting in a 'low risk' to the rights and freedoms of affected data subjects (details supplied). I thank the Deputy for bringing this matter to my attention. My officials will meet with Tusla in the near future in a previously arranged meeting to discuss Data Protection matters in general. I can assure the Deputy that this matter will also be discussed at that time.

As the Deputy is aware the Performance Framework for 2024-2026 clarifies for Tusla that it is expected to “progress its use of digital innovation and data management ...in the delivery of its services in line with related policy and legislation as well as guidance published by ... the Data Protection Commission” amongst others. I believe that this direction which covers the period 2024 – 2026 is clear and further direction is not necessary at this time.
