283. To ask the Minister for Enterprise, Trade and Employment if his Department has examined the issue of file padding in the workplace, where employers fabricate or exaggerate disciplinary records to justify dismissal, demotion, or other adverse actions; if such practices will be recognised as a form of workplace harassment; if legislative measures are being considered to prevent and penalise such conduct; and if he will make a statement on the matter. Ireland has a comprehensive body of employment, equality, and industrial relations legislation, which offers the same protections to all employees legally employed under a contract of employment. All employers, regardless of sector, are responsible for ensuring that their employees receive all the protections afforded them under employment legislation.

The Workplace Relations Commission (WRC) is an independent, statutory body under the aegis of my Department. The WRC’s primary functions include the inspection of employment law compliance, the provision of information on employment law, mediation, adjudication, conciliation, facilitation, and advisory services.

Individuals who consider their employment rights have been infringed may refer a complaint to the WRC for adjudication. Further information on employment rights and how to lodge a complaint with the WRC can be accessed at www.workplacerelations.ie.
