359. To ask the Minister for Transport, Tourism and Sport the Irish and EU legislation regulating the use of heavy goods vehicles and more specifically, the legislation relevant to load securing; to set out in summary the relevant EU legislation that has been transposed in the past ten years, including Directive 2014/47/EU; and if he will make a statement on the matter. The current EU and national legislation governing HGV’s in Ireland is listed below.

Act/EU Directive/Regulation Subject Matter Enabling Irish Legislation (including amendments)
Regulations EC 1071 of 2009 1071 – Establishing common rules for the pursuit of the road transport operator occupation SI 265/2018 as amended by SI 208/2023 and SI 28/2025
Directive 2006/22/EC Enforcement Directive SI 27/2025

Article 13 of EU Directive 2014/47 sets out requirements for load security. As this is not currently a mandatory requirement under the Directive, it has not been transposed into Irish law. However, Action 90 of Phase 1 of the Road Safety Strategy does address the issue of load security. This action is currently being reviewed by the RSA, which has been asked by the Department to undertake the role of roadside inspections for load security.
