1634. To ask the Minister for Health if she will clarify whether the HSE or their funded agencies continue to apply the ‘in loco parentis’ rule to children receiving home support; if so, whether the clause applies to all home support for children with additional needs or only to children with complex medical needs; and if the clause is still applied, whether the Minister would consider the abolition of the in loco parentis rule for all families receiving home support for children in view of the well documented difficulties arising for parents, including removing the clause from home support delivered by agencies funded by the HSE.
