1264. To ask the Minister for Agriculture, Food and the Marine the reason a young farmer (details supplied) who applied for TAMS 3 young farmers in 2024, following a successful application for national reserve and complementary income for young farmers in 2023, and who has a 33% shareholding in the family farm, has now been refused due to the share type and denied young farmer funding; and if he will make a statement on the matter. The person named was approved for grant aid under the Young Farmer Capital Investment Scheme, which is a measure under the Targeted Agricultural Modernisation Scheme (TAMS 3). They submitted a claim in respect of their completed investment on 28 May 2024.

Following an examination of the payment claim and subsequent legal advice received, it was found that the young farmer owns an inferior category of shares, compared to the other shareholders in the company.

It was also found that the category of share type held by the young farmer prevents them from exercising effective and long term control over the partnership or legal person in terms of decisions related to management, benefits and financial risks, either solely or jointly together with other members of the partnership, as set out in the terms and conditions of the scheme.

The applicant was notified of this decision on 10 January 2025 and given the right to a review, which was subsequently submitted to my Department. It is expected that the outcome of this review, which is currently being undertaken by my Department, will issue to the applicant in the coming weeks.
