To ask the Minister for Communications, Climate Action and Environment to provide a copy of the authorisation given to An Post on 26 May 1989 to award increases in pensions to retired staff; the legislative provision for the delegation; the reason the delegation was withdrawn in 2007; and if he will make a statement on the matter. My Department delegated authority to An Post to implement pension increases on 26 May 1989. I have asked my officials to source a copy of the authorisation as requested by the Deputy and to revert directly to the Deputy in due course.
I am advised that this delegated authority was withdrawn in January 2008 following legal advice received from the Attorney General.
In accordance with the Postal and Telecommunications Services Act 1983, the An Post Superannuation Scheme Rules, and the Code of Practice for the Governance of State Bodies, An Post must seek Ministerial approval from both the Minister for the Environment, Climate and Communications, and the Minister for Public Expenditure, NDP Delivery and Reform, to increase pensions and deferred pensions for members of the An Post superannuation scheme.
