934. To ask the Minister for Housing, Planning, and Local Government if, without any further delay, he will refuse the request by the then- Minister for Children, Equality, Disability, Integration and Youth, Roderic O'Gorman, to annul the decision by the councillors in the Athlone/Moate district of Westmeath County Council, which they took to invoke a prohibition order regarding the erection of temporary dwellings at Lissywollen, Athlone, under legislation available to them and contained in the Sanitary Services Act 1948 and the Local Government Reform Act 2014; and if he will make a statement on the matter. The members of Athlone-Moate Municipal District agreed at their meeting of 30 October 2024 to make an Order under Section 31 of the Local Government (Sanitary Services) Act 1948 Act prohibiting the erection or retention of temporary dwellings on a site at Lissywollen, Athlone. The Order was subsequently published on 4 November 2024, in accordance with the 1948 Act.

In accordance also with Section 31 of the 1948 Act, the then Minister for Children, Equality, Disability, Integration and Youth, on 16 November, 2024, made an application to the then Minister for Housing, Local Government and Heritage seeking the annulment of the Order made by Athlone-Moate Municipal District members.

I can confirm that the Section 31 process remains ongoing and, as such, it would be inappropriate to comment further.
