To ask the Minister for Housing, Planning, and Local Government regarding the High Court’s ruling that wind turbine noise constitutes a nuisance (details supplied), if the Minister will confirm whether wind farm noise at 43 decibels LA90 is considered a statutory nuisance; and if he will make a statement on the matter. The Department of the Environment, Climate and Communications (DECC) has primary responsibility for for environmental noise matters, to include the consideration of matters arising from the High Court judgement referred to.

In this regard, my Department is working in conjunction with DECC, in the context of its environmental noise policy remit, to finalise the guidance on the noise aspect of the review of the Wind Energy Development Guidelines to ensure that the final Guidelines, once published, are robust and fit for purpose having regard to international best practice and standards.
