496. To ask the Minister for Public Expenditure and Reform if the ownership of a property (details supplied) will be transferred; and if he will make a statement on the matter. [12697/25]

In 1983 the Minister for Finance (“lessor”) granted a lease of the former National School, Kilgarvan to the Trustees of Kilgarvan Community Council (“lessees”) for a 99-year period for the purpose of a community centre. Under the terms of the lease the lessees are responsible for all repairs and maintenance of the property.

As two of the original Trustees are now deceased the advice of the Chief State Solicitor (CSSO) was sought on whether the State could enter a new lease or accept new trustees to the existing lease. As there is an existing lease in place, the Office of Public Works (OPW), on behalf of the Minister, cannot currently enter into a new lease agreement or sell the property pending receipt of legal advice.
