331. To ask the Tánaiste and Minister for Justice and Equality if a designated immigration officer could be requested to contact an applicant (details supplied) setting out in detail the requirements to obtain a work permit in the State. [10369/25]

I am advised that the person concerned entered Ireland in April 2024 and was granted a visitor permission. They then sought to register on a Stamp 2 basis as student, however, this request was refused as they did not have the appropriate permission to register. When a person comes to Ireland as a visitor, they are expected to leave Ireland before the expiry of their visitor permission. A visitor permission can only be extended or altered in exceptional circumstances following an application to my Department’s Domestic Residence Division.

I can advise the Deputy, that there are several different legal pathways available to person referred to if they wish to move to Ireland.

If the person concerned wishes to enter the State on the basis of an employment permit, they must first obtain an employment permit before travelling to Ireland and then obtain an immigration permission from my Department.

If the person concerned has been in a durable relationship and cohabitated with their Irish partner for least two years, they may apply for permission to remain in Ireland as the de facto partner of an Irish national. If a person is not eligible to be granted permission as a de facto partner but wishes to reside in Ireland as student, I can advise that they may seek to be registered on a Stamp 2 basis if they are enrolled on a course listed on the Interim List of Eligible Programmes. However, they must enter the State as a student and be granted the appropriate temporary permission to register on a Stamp 2 basis at a port of entry.
