364. To ask the Minister for Children, Equality, Disability, Integration and Youth further to Parliamentary Question No. 311 of 20 February 2025, how a decision was made to award the contract in question since demonstrating compliance with planning law was a mandatory requirement of his Department’s own request for tender and as it would have been evident to his Department that this requirement could not be met by the tenderer because the relevant planning authority, Kildare County Council, had already determined the proposal to be in breach of planning law. Thank you Deputy for your further question on this matter.

As you will understand, planning matters relating to a property are a matter between the Local Authority and the property owner or service provider.

We continue to await the outcome of the legal process undertaken by the accommodation provider against An Bord Pleanála, which they dispute breaches planning law, and any potential direction by the regulatory body relating to these matters.

Officials in my Department continue to make significant efforts to source suitable accommodation for international protection applicants, as is required under EU and Irish law.
