354. To ask the Minister for Education and Skills the reason members of Dáil Éireann are prohibited from being members of an education or training board and, therefore, a board of management under the Education and Training Boards Act 2013, 34 (b); and if she will make a statement on the matter. The Education and Training Boards Act 2013 provides at Section 34(1)(b) that a person may not be a member of a board of an education and training board if she or he is elected as a member of either House of the Oireachtas or of the European Parliament.
There is no provision in the legislation that precludes a member of Dáil Éireann from being a member of a committee of an ETB which performs the functions of a board of management of an ETB school where such a member is elected or nominated as applicable in accordance with the agreed composition of such boards of management.
