325. To ask the Minister for Health her views on whether section 15 of the Public Health (Alcohol) Act 2018 is being breached by alcohol companies; if not, if she will commit to changing the definition of “advertising” in the 2018 Act to specifically include zero alcohol drinks using the same branding, logos, colours and name as their parent company; and if she will make a statement on the matter. The Public Health (Alcohol) Act 2018 was developed to address the health harms associated with alcohol consumption. The provisions of the Act which restrict the advertising of alcohol products are important measures in the reduction of alcohol consumption and the associated harm. My current priority is to finalise regulations relating to the content of alcohol advertisements under section 13 of the Public Health (Alcohol) Act. These regulations, along with section 13, will provide that alcohol advertisements must contain health warning and that their content is limited to factual information.

In monitoring the evidence on the impacts of alcohol advertising on consumption and health harms, my Department also monitors evidence relating to impacts of non-alcohol products.

Matters relating to enforcement and compliance of the Public Health (Alcohol) Act 2018 are the responsibility of the National Environmental Health Services of the Health Service Executive. I have referred the question to the Health Service Executive for direct reply to the Deputy.
