To ask the Tánaiste and Minister for Justice and Equality if he will confirm his intentions, under Protocol 21 of the Treaty on the Functioning of the European Union, to opt-in to the relevant 'freedom, security and justice' parts of the EU AI Act (Regulation (EU) 2024/1689); if he will outline the reasoning for the same; if he will confirm that the information as outlined on the Department of Justice website (details supplied) regarding Protocol 21 is up to date; and if she will make a statement on the matter. I can inform the Deputy that Protocol 21 does not arise in respect of the EU AI Act (Regulation (EU) 2024/1689). Protocol 21 only applies in instances where the legal basis for a new legislative measure is drawn from Title V of Part 3 of the Treaty on the Functioning of the European Union. This is not the legal basis for the EU AI Act.

The information referred to in the details supplied is a list of the Justice and Home Affairs measures Ireland has opted into under Protocol 21, and a list of the measures Ireland is automatically bound by as a result of our participation in elements of the Schengen acquis. These lists are accurate up to the end of March 2023. An exercise is underway to update this information and once completed, up-to-date lists will replace those currently on the website. I will also arrange for the updated lists to be provided directly to the Deputy once available.
