It is important to note that Section 39 organisations, such as the St. Joseph’s Foundation, are not public bodies. The terms and conditions of employment for staff in these organisations, once in-line with relevant employment legislation, are ultimately between the employer and employee.

While the HSE maintains a Red Weather policy for HSE and Section 38 organisations, as a Section 39 organisation, St. Joseph’s Foundation operate it's own policy that is required to be in line with employment law.
