1292. To ask the Minister for Children, Equality, Disability, Integration and Youth when a decision will be made on the next steps following on from An Bord Pleanála's findings on an accommodation facility (details supplied) referred by Kildare County Council for a property which is not an exempt development facility for IPAS; and if he would review this contract, given that both An Bord Pleanála and Kildare County Council believe this location should not be used for IPAS. Thank you for your question, Deputy.
The International Protection Accommodation Service currently provides accommodation to over 32,000 people at over 320 sites nationwide. Over 90% of IPAS accommodation is provided through providers with whom the Department enters into procurement arrangements.
It is important to note that matters related to planning are between the Local Authority and the accommodation service provider.
My Department is aware that, in relation to the property mentioned, on 5 November 2024, An Bord Pleanála issued its decision on whether or not it considered the development at Ryevale House to be exempted development. Its decision was that the property is not exempted development.
The accommodation provider has a legal entitlement to challenge this decision and we understand that the provider lodged a judicial review of the An Bord Pleanála decision to the High Court on 13 December 2024.
Kildare County Council issued a warning letter to the accommodation provider on 9 December 2024 following the An Bord Pleanála decision, however it has confirmed to the provider that it cannot enforce any orders on the property until the judicial review is heard.
The property continues to accommodate people seeking international protection applicants while the above processes are ongoing.
