816. To ask the Minister for Agriculture, Food and the Marine if the case of a person can be examined (details supplied); and if he will make a statement on the matter. [44028/24]

The BISS application for the herd owner referred to by the Deputy was submitted by his FAS Advisor on 10 May 2024. During BISS Preliminary checks, a dual claim was identified and notified to the herd owner on 4 June 2024. A response was received on 17 June 2024 stating the applicant had the right to claim the land parcels concerned.

As a result, my Department issued a dual claim letter on 3 July 2024 requesting evidence of the right to claim the parcels in question. On the 8 August 2024, the herd owner subsequently responded stating that he did not have the right to claim the parcels. As a result, the relevant penalty was applied.

On the 21 October 2024, an appeal was received from the herd owner with supporting documentation. That appeal is currently being considered and the finding of that appeal will be notified directly to the herd owner shortly.
