231. To ask the Minister for Agriculture, Food and the Marine if there is an appeals process in relation to the ACRES scheme; and if he will make a statement on the matter. [38405/24]

I can confirm that there is an appeals process in relation to the ACRES scheme, as it is one of the schemes listed in the Schedule of the Agriculture Appeals Act, 2001. Participants in ACRES may therefore submit appeals in respect of decisions taken in relation to their participation in the Scheme.
The appeals process in respect of ACRES is outlined in Section 28 of the Scheme Terms and Conditions.
The usual sequence is that participants seek an internal review by my Department of the decision concerned in the first instance. The internal review shall be without prejudice to the right to appeal formally to the Agriculture Appeals Office. So, where a participant is dissatisfied with the outcome of the internal review, they may then formally appeal to the Appeals Office.
