163. To ask the Minister for Education and Skills the supports that will be put in place for nurses and boarding staff made redundant at a school (details supplied), given the school’s inability to pay statutory redundancy at the current time owing to financial issues. [38415/24]

Under the provisions of the Education Act 1998, the board of management is the body charged with the direct governance of a school. While the Department sets out the composition of boards of management and rules of procedure it is not directly involved in the management of schools. While the Department allocates certain staff such as teachers and SNAs, where a school uses other income to employ a staff member directly the individual schools hold responsibility for terms of employment and their rate of pay rests with the school or Board of Management. The Department of Education does not play a role in the agreement of these terms of employment.
As employer, the terms of the redundancy of such are a matter for the school. I understand that where an employer is unable to meet it statutory obligations pursuant to the Redundancy Payments Act they may qualify under the Redundancy Payment Scheme, which is a payment to an employee from the Social Insurance Fund which is managed by the Department of Social Protection and the school could seek advice from that Department.
