49. To ask the Tánaiste and Minister for Justice and Equality for an update on efforts to ban face coverings at protests; and if she will make a statement on the matter. [37609/24]

In the context of the recent increase in public order incidents related to protests, the Garda Commissioner asked that I consider amending public order laws to provide a power to Gardaí to direct a person to remove a face covering that is worn for the purposes of intimidating others.

While the right to peaceful protest is a cornerstone of any democracy, this does not give people the right to intimidate and instil fear in others.

I have consulted with the Attorney General, who has advised that the proposals are legally sound, though complex. I have also further consulted with the Garda Commissioner in respect of the proposals. My officials are examining the legal advices and views received to determine how the proposed amendments can best be progressed.

I expect to be in a position to seek approval to draft the necessary legislation very shortly.

The introduction of Body Worn Cameras, the delivery of stronger incapacitant spray, and the introduction of more body armour have all been done to help Gardaí in keeping us all safe.

Likewise, the objective of this legislation is to ensure correct laws are in place to ensure Gardaí have all the powers required to protect public order while also supporting the right to peaceful protest.
