342. To ask the Minister for Education and Skills the options available to the son of a person (details supplied); and if she will make a statement on the matter. [36880/24]

Where a board of management makes a decision to refuse admission to a school, a parent/guardian can appeal that decision under Section 29 of the Education Act 1998 (as amended) and an independent appeals committee will be appointed to consider that appeal.

The person concerned to which the Deputy refers currently has an appeal in progress under Section 29 of the Education Act 1998 (as amended).

This department has no authority to compel a school to admit a student, except in circumstances where an appeal under Section 29 of the Education Act 1998 (as amended) has been allowed, and the appeals committee directs that the school admit the child concerned.

The Section 29 Administration Unit are processing this appeal which is due to be heard by an independent appeals committee on 18 September 2024 and we await the outcome of that appeal.

It may be useful for you to be aware that the Educational Welfare Services within Túsla Education Support Services (TESS) is the legal body which can assist parents who are experiencing difficulty in securing a school placement for their child.
