1246.To ask the Minister for Employment Affairs and Social Protection for an update on sick leave policy affecting a staff member within her Department following a surgical procedure (details supplied); and if she will make a statement on the matter. [31215/24]

The sick leave of all Civil Servants is governed by 'Circular 12/2023: Management of Sick Leave in the Civil Service.'

"Point 4.1 states:

4.1 Limits for Paid Sick Leave

Subject to compliance with section 3.1, civil servants may avail of a maximum of 183 days of paid sick leave in a rolling 4-year period, counting back from the day preceding the first day of their current absence.

Where the civil servant has not exceeded this threshold, they may avail of the following, subject to the above overriding maximum:

• 92 days on full pay in a rolling 1-year period, counting back from the day preceding the first day of their current absence

• Where the full-pay threshold has been exhausted, 91 days on half pay in a rolling 1-year period

If during the 4 year rolling period, an officer has instances of previous sick leave, this will affect their entitlement to full pay or half pay when they take a further instance of sick leave.

Please advise the Officer concerned to contact the DSP HR Absence Team or the National Shared Services Office in relation to further clarification on this matter.
