144. To ask the Minister for Housing, Planning, and Local Government the options local authorities have in implementing Part V planning in terms of accepting payment in lieu of houses and accepting houses in another location which would be more beneficial to the local authority; and if he will make a statement on the matter. The purpose of Part V is for the State to capture a portion of the increase in land value resulting from the granting of planning permission for residential development. The current Part V legislation provides for local authorities to acquire up to 20% of this land at existing use value and to use it to deliver homes to those households who qualify for social and affordable housing support.
Part V also allows the local authority to avail of other options to satisfy the Part V requirement as an alternative to the transfer of land including:
i) the transfer of completed housing units on the land subject to the application;
ii) the transfer of completed housing units on other land within the functional area of the local authority;
iii) the grant of a lease of houses on the land subject to the application, or on any other land within the functional area of the local authority; or
iv) any combination of the aforementioned options.
The option for developers to satisfy the Part V requirement by means of a cash payment to local authorities is no longer available having been abolished under previous amendments to Part V in 2015.
