To ask the Minister for Housing, Planning, and Local Government the total number of affordable/rentable houses likely to accrue to Kildare County Council through Part 8/Part 5 of the planning process; the number of such houses completed or near completion; if 10% or 20% is the appropriate number of houses likely to be available for reletting by the planning authority; and if he will make a statement on the matter. Part 8 of the Planning and Development Regulations 2001 sets out the procedure for a local authority when carrying out development, including social and affordable housing, on its own land.
Part V of the Planning and Development Act 2000 ensures that a local authority gains a portion of the increase in the land value resulting from the local authority granting planning permission for private residential development.
The Part V provisions were amended by the Affordable Housing Act 2021 which came into operation on 3 September 2021. The effect of the amendments is to increase the Part V contribution to 20% in housing developments of 5 or more houses, and to broaden the use of Part V to cost rental as well as social and affordable purchase housing. At least half the Part V contribution must be for social housing provision. The other half of the Part V contribution will be used for the provision of affordable homes which will be made available to approved affordable housing candidates in accordance with the Affordable Housing Act 2021.
Each local authority, including Kildare County Council, has prepared and published a Housing Delivery Action Plan setting out it's plans to deliver social and affordable housing during the period from 2022 to 2026. Kildare has published its plan which is available at the following link
