124. To ask the Minister for Communications, Climate Action and Environment how the human cremation process is regulated; the statutory reporting responsibilities of crematoria relating to air, water and soil quality in the areas adjacent to the crematorium; to whom crematoria report; and if he will make a statement on the matter. My Department has no function in relation to the regulation of the human cremation process. The power to make regulations in relation to this process rests with the Department of Housing Local Government and Heritage under Planning legislation and Section 47 the Local Government (Sanitary Services) Act.

Crematoria are not currently a licensable activity under the Air Pollution Act (1987) and as such I am not aware of any specific reporting requirements that may apply in relation to air quality.
