695. To ask the Minister for Employment Affairs and Social Protection if she will expedite an application by a person (details supplied) for disability allowance; and if she will make a statement on the matter. [55098/22]

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions in relation to social welfare entitlements

The Social Welfare Appeals Office has advised me that the Disability Allowance appeal of the person concerned was disallowed by an Appeals Officer by way of a summary decision. The person concerned was notified of the decision on 12 October 2022.

It is open to the person concerned to request a review under Section 317 of the Social Welfare Consolidation Act 2005 and to submit any additional fresh evidence or facts he may have in support of the review. On receipt of a request for a 317 review, the Appeals Officer will consider whether the decision may be revised in the light of the new evidence or new facts which have been brought to their notice. The Appeals Officer will make a summary decision on the review based on the documentary evidence presented or, if necessary, hold an oral appeal hearing.
