To ask the Tánaiste and Minister for Justice and Equality her plans to amend the Multi Unit Development Act; if he will provide guidance on the criteria and thresholds that must be met in order to make a determination that an estate is unfinished; and if she will make a statement on the matter. The Programme for Government contains a commitment to conduct a review of the existing management company legislation, to ensure that the legislation, i.e. the Multi-Unit Developments Act 2011, is fit for purpose and that it acts in the best interests of residents. This will be led by my Department, supported by the Department of Housing, Local Government and Heritage.
Section 1 of the 2011 Act defines when the development stage of a multi unit development is completed. Developers are required to comply with the requirements and conditions of planning permission under the Planning and Development Acts as well as with the requirements of Building Control Acts and relevant provisions of the 2011 Act.
