218. To ask the Tánaiste and Minister for Justice and Equality the number of prosecutions of motorists in each of the past five years for failure to make progress and drive at the appropriate speed limit for the road and their vehicle under the rules of the road; and if she will make a statement on the matter. As the Deputy will be aware the Director of Public Prosecutions (DPP) is an independent law officer under the provisions of the Prosecution of Offences Act 1974 (as amended). The Office of the DPP is under the Vote of the Department of the Taoiseach and I have no role in the functions of the Director or the Office of the DPP and am unable to provide statistical information relating to the functions of the Director.

To be of assistance, I have made enquiries with the Courts Service to ascertain information relating to convictions relating to the Deputy's query. However, the Courts Service have advised that there is no offence code for “driving too slow” or "failure to make progress and drive at the appropriate speed limit". Therefore the information sought by the Deputy cannot be provided.
