To ask the Minister for Transport, Tourism and Sport if a disabled parking space that is not located on a public road such as in a private car park for a shopping centre or other building, is legally unenforceable if a non-disabled driver uses it; if so, his plans to address same; and if he will make a statement on the matter. Disabled parking regulations, as with every other aspect of road traffic law, can only be enforced on public roads and car parks.
The installation and enforcement of disabled bays in private car parks such as those attached to shopping centres and other commercial premises is the responsibility of the car park's owner. Neither An Garda Síochána nor local authority traffic wardens have the legal powers to issue Fixed Charge Notices (FCNs) on private property.
