231. To ask the Minister for Housing, Planning, and Local Government further to Parliamentary Question No. 599 of 15 June 2021, his views on the contents of the 9 February 2013 Report of the Independent Review of the Compulsory Acquisition of Land at Charlesland, County Wicklow by Wicklow County Council. The independent review referenced sought to establish the processes followed by Wicklow County Council and to identify any deviation from relevant legal requirements and administrative requirements or practices. The review found that there was no such deviation by the Council from such requirements.

The review was carried out in accordance with the agreed terms of reference that addressed each of the specific concerns that had been raised by certain public representatives during 2011.

The review was carried out on a non-statutory basis and as such the reviewer did not have powers to make any binding determinations of facts. The report states that any findings or conclusions made should be viewed in that context. The content of the report should therefore be viewed as the findings of an expert counsel following professional scrutiny and analysis of the processes followed by the Council.
