261. To ask the Minister for Agriculture, Food and the Marine when a 2020 area of natural constraint overclaim refund payment will issue to a farmer (details supplied) in County Kerry; and if he will make a statement on the matter. [13593/21]

The person named applied under the 2020 Areas of Natural Constraints (ANC) scheme on 6th May 2020. Based on the information available to the Department at the time of application, it was determined that the person named had made an overclaim. This penalty was applied to the payment which issued from my Department on 15th January 2021.

Following a review of the overclaim based on additional information provided by the person named, this penalty has now been removed and the money has been refunded by my Department.

An application under the 2016 Areas of Natural Constraints (ANC) Scheme was received from the person named on 4th May 2016.

In order to qualify for payment, participants were required to meet minimum requirements regarding stocking density and retention. As the person named used equines to make up his stocking requirements, it was necessary for him to demonstrate that his premises are registered with the Department as an equine premises.

This person named has recently demonstrated this and the 2016 ANC payment has now issued from my Department.

An application to participate in the 2020 Areas of Natural Constraints (ANC) scheme was submitted by the person named on 30th April 2020.

Under the terms and conditions of the scheme, participants are required to meet minimum requirements concerning stocking density and retention. Additional documentation in the form of a flock register and equine passports were requested by my Department from the person named to confirm that they had met these requirements. These documents have been provided to my Department, following which my Department has been able to confirm that the person named has met the minimum requirements.

I am pleased to confirm that payment for the 2020 ANC scheme has now issued to the person named.

An application under the 2020 Areas of Natural Constraints (ANC) scheme was submitted by the person named on 27th March 2020.

Under the terms and conditions of the scheme, participants were required to meet minimum requirements concerning stocking density and retention. Additional documentation in the form of a flock register and equine passports were required by my Department from the person named to confirm that they had met these requirements.

These documents have subsequently been provided and the Department has been able to confirm that the person named has now met the minimum requirements. Payment for the 2020 ANC scheme will issue shortly.

265. To ask the Minister for Agriculture, Food and the Marine when a 2020 basic payment and area of natural constraint payment for a commonage will issue to a farmer (details supplied) in County Kerry; and if he will make a statement on the matter. [13597/21]

The person named submitted a Basic Payment Scheme (BPS) application in 2020.

Their BPS application contained a commonage parcel. As a result of standard administrative checks carried out by my Department, it was found that the specific commonage parcel was overclaimed.

In that context, a full review of all evidence submitted to support the various applicants' claims on the specific commonage parcel in question was required. That review is now being finalised and my Department will be contacting each of the applicants shortly advising them of the outcome of the review. It is envisaged payment will issue to those with a right to claim the commonage parcel in the coming weeks.

In December 2020, a BPS and ANC payment was made to the named person on the non-commonage parcels on their 2020 BPS application.
