102. To ask the Minister for Communications, Climate Action and Environment if a company or a person is prohibited from operating waste disposal services using the permit of another company in cases in which they have been convicted for illegal dumping in the past; if it is an offence if they continue to operate using the permit of another company; and if he will make a statement on the matter. Section 34(1)(a) of the Waste Management Act provides that a person other than a local authority shall not, for the purposes of reward, with a view to profit or otherwise in the course of business, collect waste, except under and in accordance with a waste collection permit, unless otherwise specified in regulations.  There are no provisions enabling a company or person from operating waste disposal services using the permit of another company or person. Penalties available under the Waste Management Acts are substantial. Persons who are found to be responsible for, or involved in, the unauthorised collection or disposal of waste are liable to a Class A fine on summary conviction and/or imprisonment for up to 12 months, and to a maximum fine of €15 million on conviction on indictment and/or imprisonment for up to 10 years.
